Terms of use
Effective October 28, 2026. These terms cover the website datafacttree.com only.
By using this site you agree to the terms below. If you do not agree, please do not use it. Work we do for a client is governed by a separate written agreement, and where that agreement and these terms differ, the agreement wins.
1. Who we are
The site is operated by Data Fact Tree, LLC, a Virginia limited liability company based in Alexandria, Virginia ("we", "us"). You can reach us at info@datafacttree.com.
2. Using the site
You may read the site, link to any page, and quote short excerpts with attribution and a link. You may use the code examples in our articles in your own projects; they are provided as is, without warranty. In return you agree not to:
- copy, republish, or redistribute substantial parts of the site, or collect its content by automated means beyond what search engines ordinarily do;
- submit a booking or message under a false name, on behalf of someone who has not asked you to, or for the purpose of sending us advertising;
- probe, overload, or interfere with the site, its booking and message systems, or its administrative areas, or try to get around the limits that protect them;
- remove or alter any notice of ownership on content you are permitted to use.
We may block access from any source that breaks these rules.
3. Information, not advice
Articles, papers, examples, and figures on this site are general information about engineering. They are not advice for your systems or your situation, and they are not an offer to do work on particular terms. Test anything before you rely on it. Figures labeled "Prior experience" are explained where they appear; they are not a promise of results for your systems.
4. Our content and marks
The text, images, drawings, and code on this site, and the Data Fact Tree name, tree mark, and the tagline "Engineering intelligence", belong to us unless we say otherwise, and are protected by copyright and trademark law. The names of employers, products, and technologies mentioned on the site belong to their owners; we use them only to describe where work was done or what it used, and their appearance here does not mean those organizations endorse us or we them.
Research papers linked from the site are published by their publishers under the publishers' terms. Our own articles may be quoted as described in section 2.
5. Bookings and messages
Booking a call or sending a brief creates no obligation on either side: we may decline or reschedule a call, and you may cancel one at any time using the link in your confirmation email. You confirm that the details you give us are accurate and yours to give.
Please do not send confidential information through the site. Until a written agreement with a confidentiality clause is in place, anything you send us is received without an obligation of confidence, though we treat it with ordinary business discretion and handle personal information as described in our privacy notice.
6. Third-party sites and embedded content
The site links to pages we do not control, such as LinkedIn, Google Scholar, and IEEE Xplore, and research entries may embed videos hosted by YouTube. Those services have their own terms and privacy policies, and we are not responsible for their content or practices. A link is a reference, not an endorsement.
7. No warranty
The site and everything on it are provided "as is" and "as available", without warranty of any kind, express or implied, including any warranty of accuracy, completeness, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. We work to keep the site correct and available, and we correct errors when they are pointed out, but we make no promise about either.
8. Limitation of liability
To the fullest extent permitted by law, we are not liable to you for any indirect, incidental, consequential, special, or punitive loss, or for any loss of profit, data, or business, arising from the site or anything on it, however caused. Where liability cannot be excluded, our total liability to you for all claims relating to the site is limited to one hundred US dollars (USD 100). Some jurisdictions do not allow some of these limits, so some may not apply to you. Nothing in these terms limits liability for fraud or for anything that cannot lawfully be limited.
These limits apply to the free use of this website. Liability for work we do for a client is set out in that client's agreement.
9. Your responsibility for misuse
If your breach of section 2 leads to a claim against us by a third party, you agree to cover the reasonable costs we incur as a result, including reasonable legal fees.
10. Governing law and disputes
These terms are governed by the laws of the Commonwealth of Virginia and the federal laws of the United States, without regard to conflict-of-law rules. Any dispute about the site or these terms will be brought in the state or federal courts located in Alexandria, Virginia, and you consent to their jurisdiction. If you live somewhere whose law gives you rights that cannot be taken away by this clause, those rights remain yours.
11. Changes
We may change these terms. The effective date at the top changes when we do, and earlier versions are available on request. Continued use of the site after a change means you accept the new terms.
12. General
If any part of these terms is found unenforceable, the rest still applies. Our not enforcing a term on one occasion does not waive it for later. These terms are the whole agreement between you and us about your use of the site; the privacy notice describes our practices and is not part of it. Nothing here creates a partnership, employment, or agency relationship. You may not transfer your rights under these terms; we may transfer ours to a successor of the firm.
